Se declaró la nulidad de todo lo actuado en la presente tutela a partir del auto proferido por el Juzgado que admitió tramitar la tutela instaurada por el accionante de la referencia, toda vez que para determinar la competencia, en la tutela, el factor es el territorial, que obedece a circunstancias objetivas e inherentes a la acción, con absoluta prescindencia de elementos subjetivos, luego tratándose de la tutela ese factor territorial es de orden público.
En consecuencia, se ordenó remitir el expediente a los Jueces Civiles del Circuito en Bogotá (Reparto) para que se reinicie la tramitación de la acción y se profiera la decisión correspondiente.

- En merito de lo expuesto la Sala Septima de Revision de la Corte Constitucional
- RESUELVE:
- DECLARAR LA NULIDAD de todo lo actuado en la presente tutela a partir del auto que aparece con fecha 15 de febrero de 1999, proferido por el Juzgado 2deg Civil del Circuito de Cartagena, que admitio tramitar la tutela instaurada por Antonio Martinez Sistac y, en consecuencia, ORDENAR que por la Secretaria de la Corte Constitucional se remita el expediente de tutela a los Jueces Civiles del Circuito en Santafe de Bogota (Reparto) para que se reinicie la tramitacion de la accion y se profiera la decision correspondiente.
